Terms and Conditions

Welcome to PetScrub. These Terms and Conditions and Liability Waiver (“Agreement”) govern your use of the PetScrub self-serve pet washing machines, facilities, technology platform, and related services (collectively, the “Services”).

By checking the “I Agree” box on the digital interface, accessing, purchasing, or using the PetScrub facility and machinery, you (“Customer”, “User”, “Attendee”, “Contractor”, “You”) agree to be bound by this Agreement. If you do not agree to these terms, do not check the box or use the PetScrub machine.

1. Acceptance of Terms

By checking the required box to approve these terms and using the PetScrub machine or facility, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions. You confirm that you are the legal owner or authorized handler of the pet(s) being washed, or a hired professional, and are at least 18 years of age.

2. Description of Service, Marketplace Platform, and Independent Attendees

PetScrub provides self-serve pet washing machinery designed to dispense water, shampoos, conditioners, and drying air. Customers have two options for utilizing the facility:

  • Self-Serve: You wash the pet yourself using our equipment.
  • Done-For-You (Attendees / Independent Contractors): You may elect to have your pet washed by an individual offering services at the PetScrub facility.

IMPORTANT DISCLAIMER FOR CUSTOMERS (MARKETPLACE MODEL):

PetScrub operates strictly as a medium, facility, and technology platform—similar to a marketplace model. PetScrub does not provide pet washing or grooming services. Any individuals (Attendees or Contractors) offering “done-for-you” washing, drying, or grooming services at the PetScrub facility are completely Independent Contractors and are NOT employees, agents, partners, or representatives of PetScrub.

PetScrub solely provides the equipment and facility as a medium for their services. PetScrub has no service agreement with the Contractor or Attendee. PetScrub does not vet, train, supervise, or control these independent Attendees. Your decision to hire them is a direct and exclusive agreement between you and the Attendee. PetScrub assumes absolutely zero liability for the acts, omissions, negligence, misconduct, or quality of service of any Attendee.

3. Pet Health, Safety, Sickness Liability, and Behavior Requirements

To ensure the safety of all users and animals, you agree to the following conditions regarding the pet being washed:

  • Vaccinations: The pet must be up-to-date on all veterinarian-recommended vaccinations (including Rabies, Distemper, and Parvovirus).
  • Health: Pets must be in good health. Pets recovering from surgery, pregnant, nursing, or with open wounds, stitches, or severe skin conditions should not use the PetScrub machine.
  • Parasites: Pets must be free of fleas, ticks, and other contagious parasites.
  • No Liability for Sickness: You acknowledge that bringing a pet to a public facility carries an inherent risk of exposure to communicable diseases, pathogens, and illnesses. PetScrub explicitly removes and disclaims all liability if a dog gets sick, contracts an illness (such as Kennel Cough, Canine Influenza, Parvovirus, etc.), or develops any medical condition during or following a visit to the PetScrub facility.
  • Behavior: You are solely responsible for the pet's behavior. Pets that exhibit extreme aggression, severe anxiety, or panic when exposed to water, enclosed spaces, or loud noises (such as dryers) should not use the machine.

4. Machine Use, Supervision, and Mandatory Sanitation

  • Mandatory Disinfectant Use: To prevent the spread of bacteria and disease, all Users and Attendees are strictly required to use a veterinary-grade disinfectant on any brushes, combs, or shared tools immediately before and after each use. By using the facility, you agree to this mandatory sanitation protocol. PetScrub is not liable for any User's or Attendee's failure to properly sanitize equipment.
  • Supervision: The pet must be actively supervised at all times. If you are the owner utilizing an independent Contractor/Attendee, you must remain on the premises and you remain ultimately responsible for your pet's behavior.
  • Proper Use: You agree to follow all posted instructions, screen prompts, and safety warnings on the PetScrub machine.
  • Restraints: The provided tethers/restraints inside the machine must be used to secure the pet, preventing them from jumping out and injuring themselves.
  • Prohibited Items: Do not use outside grooming tools (clippers, scissors) inside the PetScrub machine unless you are a licensed professional, and even then, only at your own risk.

5. ASSUMPTION OF RISK (PLEASE READ CAREFULLY)

You acknowledge and understand that washing a pet involves inherent risks. These risks include, but are not limited to:

  • For the Pet: Contracting a sickness, virus, or disease from a public space; allergic reactions to shampoos or conditioners, eye or ear irritation from soap or water, anxiety, panic attacks, stress, slipping, falling, jumping from the machine, injuries caused by independent contractors, or strangulation/injury from safety tethers if the pet panics.
  • For the User/Contractor: Slips, trips, and falls on wet floors surrounding the machine; water damage to personal electronics or clothing; and bites, scratches, or physical injuries caused by the pet or other pets in the facility.

BY USING THE PETSCRUB MACHINE OR HIRING/ACTING AS AN INDEPENDENT CONTRACTOR ON-SITE, YOU VOLUNTARILY ASSUME ALL KNOWN AND UNKNOWN RISKS ASSOCIATED WITH THE PROCESS.

6. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

To the fullest extent permitted by law, you hereby expressly waive, release, and forever discharge PetScrub, its founder (Kamel Takla), officers, directors, employees, property owners, and affiliates (collectively, the “Released Parties”) from any and all claims, liabilities, demands, causes of action, damages, or costs (including medical or veterinary expenses) arising out of or related to:

  • Any injury, illness, sickness, disease, or death of a pet while using or after using the PetScrub facility, whether being washed by an owner or an independent Contractor/Attendee.
  • Any acts, omissions, negligence, misconduct, or quality of service provided by any independent Attendee performing “done-for-you” services.
  • Any personal injury or property damage sustained by you (whether you are a customer or a contractor) or any third party accompanying you.
  • Any allergic reactions, skin irritations, or underlying medical conditions triggered by the washing, drying, or grooming products used in the machine.
  • Any failure by you, another customer, or an Attendee to properly disinfect brushes and tools before and after use.
  • Any malfunctions, downtime, or maintenance of the PetScrub equipment.

You agree that the Released Parties shall not be held liable for any direct, indirect, incidental, special, or consequential damages (including lost profits or business interruption) resulting from the use or inability to use the PetScrub services.

7. Indemnification

You agree to indemnify, defend, and hold harmless PetScrub and the Released Parties from any claims, losses, liability, damages, or costs (including reasonable attorney's fees) arising from:

  • Your failure to follow the instructions for the PetScrub machine or the mandatory sanitation protocols.
  • Any injury, sickness, or damage the pet causes to the machine, the facility, independent contractors, customers, or other animals.
  • Your breach of any terms in this Agreement.

8. Equipment Damage

Users are responsible for treating the PetScrub machine with care. If you, a pet under your control, or an independent contractor you hire willfully or negligently damage the equipment, hoses, nozzles, screens, or payment terminals, you may be held financially responsible for the cost of repairs.

9. “AS-IS” Service Disclaimer

The PetScrub services and machinery are provided on an “AS-IS” and “AS-AVAILABLE” basis. PetScrub makes no warranties, express or implied, regarding the suitability, reliability, uptime, sanitation, or exact performance of the machine or any Attendee operating within the facility.

10. Commercial Use and Independent Attendee Provisions

If you are an individual utilizing the PetScrub facility to provide commercial washing, drying, or grooming services to third-party clients (“Contractor” or “Attendee”), you expressly agree to the following additional terms:

  • No Employment Relationship: You are an independent professional. Nothing in this Agreement creates an employer-employee, partnership, or agency relationship between you and PetScrub. You operate independently on the PetScrub medium.
  • Sole Liability: You bear 100% of the liability for the services you provide to your clients. You agree to hold PetScrub harmless from any claims made by a client regarding your services, including injuries or illnesses to their pets.
  • No Workers' Compensation or Benefits: You acknowledge that you are not entitled to workers' compensation, health insurance, or any other benefits from PetScrub.
  • Assumption of Occupational Risk: You assume all risks associated with handling animals in a commercial capacity, including but not limited to dog bites, scratches, slips, and falls. PetScrub is not liable to you for any occupational injuries sustained on the premises.
  • Business Interruption: PetScrub is not liable to you for any lost wages, lost profits, or loss of clientele resulting from machine malfunction, facility closure, or service downtime.
  • Contractor Insurance: You are solely responsible for maintaining your own professional liability insurance and health insurance.

11. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Harris County, Houston, Texas.

12. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

BY CHECKING THE BOX TO APPROVE THESE TERMS AND PROCEEDING TO PAY FOR AND USE THE PETSCRUB MACHINE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, AND VOLUNTARILY AGREE TO ITS TERMS, INCLUDING THE RELEASE OF LIABILITY, THE MARKETPLACE PLATFORM DISCLAIMER, AND ASSUMPTION OF RISK REGARDING THE MACHINERY, SICKNESS/DISEASE, YOUR PET, AND INDEPENDENT ATTENDEES.
